1. Service Disclaimer

DYNAFABS provides a 3D printing quoting and manufacturing service. The Service is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied. We make no representations or warranties regarding the accuracy, completeness, or quality of models listed; the functionality or printability of models; the legality or compliance of models with local laws; the intellectual property rights of models; or the fitness of models for any particular purpose.

2. Intellectual Property Disclaimer

2.1 Client Responsibility for Uploaded Designs

DYNAFABS is not responsible for intellectual property infringement. Clients are solely responsible for ensuring that all design files they upload do not infringe on copyrights, trademarks, or patents; are original works or properly licensed; comply with all applicable intellectual property laws; and include appropriate attribution if required.

2.2 Client Responsibility

Clients are responsible for ensuring that all design files submitted to DYNAFABS are used in compliance with applicable licence terms. DYNAFABS does not warrant that designs are suitable for commercial use, modification, or redistribution.

2.3 DMCA Compliance

While DYNAFABS complies with the Digital Millennium Copyright Act (DMCA) and will remove infringing content upon notice, we do not actively monitor for infringement. Rights holders must submit DMCA notices to legal@dynafabs.uk.

3. Model Quality Disclaimer

DYNAFABS does not guarantee that models will print successfully on all 3D printers, that models will produce the expected results, that models are free from errors or defects, that models are compatible with specific software or hardware, or the accuracy of model specifications or dimensions.

Users should test models and verify compatibility before relying on them for production or commercial purposes.

4. File Verification Disclaimer

DYNAFABS uses automated verification to confirm that uploaded files are legitimate 3D printing files. Verification is not a guarantee of model quality or printability, does not confirm intellectual property ownership, and may not detect all defects or issues. Clients remain solely responsible for the content and accuracy of their design files.

5. Limitation of Liability

To the fullest extent permitted by law, DYNAFABS shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes lost profits, lost data, business interruption, or reputational harm, and applies even if DYNAFABS has been advised of the possibility of such damages. Your sole remedy for dissatisfaction is discontinuation of use.

5.1 Maximum Liability

The total liability of DYNAFABS for any claim shall not exceed the amount you paid to DYNAFABS in the 12 months preceding the claim.

6. Disclaimer of Warranties

The Service is provided "AS IS" without warranty of any kind. DYNAFABS disclaims all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, non-infringement or title, that the Service will be uninterrupted or error-free, and that defects will be corrected.

7. Third-Party Content Disclaimer

DYNAFABS is a 3D printing service provider. We do not assume responsibility for design files uploaded by clients, descriptions, images, or metadata provided by clients, the suitability of client-supplied designs for their intended purpose, client reviews or feedback, or any direct communications between clients and subcontract printers, which are expressly prohibited.

8. Payment Processing Disclaimer

DYNAFABS uses Stripe for payment processing. We are not responsible for payment delays or failures, incorrect payment amounts, issues with your bank or payment method, Stripe's policies or practices, or fraud or unauthorized transactions. You are responsible for maintaining accurate payment information and monitoring your account.

9. Service Availability Disclaimer

DYNAFABS does not guarantee continuous availability of the Service. We may experience scheduled maintenance and downtime, unscheduled outages or technical issues, performance degradation during peak usage, and data loss or corruption. We are not liable for any damages resulting from Service unavailability.

10. Legal Compliance Disclaimer

Users are responsible for ensuring their use of the Service complies with all applicable laws and regulations in their jurisdiction, including intellectual property laws, export control regulations, tax and financial reporting requirements, consumer protection laws, and data protection and privacy laws. DYNAFABS does not provide legal advice and is not responsible for legal compliance.

11. Prohibited Content Disclaimer

While DYNAFABS prohibits certain content, we cannot guarantee that all prohibited content will be detected or removed. If you encounter prohibited content, please report it to legal@dynafabs.uk.

12. Indemnification

You agree to indemnify and hold harmless DYNAFABS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these terms, your infringement of intellectual property rights, your violation of any laws, or your conduct or models.

13. Severability

If any provision of this disclaimer is found to be unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
